These Terms of Service (“Terms”) govern your use of vdotcalculator.com and any purchase you make from us. The website is operated by ZEYRO (“ZEYRO”, “we”, “us” or “our”). By using our website, creating an account, designing a product or placing an order, you agree to these Terms and to the policies referenced in them. If you do not agree, please do not use our website.
1. Eligibility
You must be at least the age of majority in your state, province or country of residence to place an order, or have the permission and supervision of a parent or legal guardian. You agree to use our website only for lawful purposes and in accordance with these Terms.
2. Your Account
If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please provide accurate, complete and current information and update it when it changes. Let us know immediately at Contact@vdotcalculator.com if you believe your account has been used without your permission.
3. Products and Print on Demand
ZEYRO sells original designs, premium metal wall art, HD aluminum photo panels, and print-on-demand artwork that are produced to order. Please note:
- We make every effort to display colours, prints and products accurately, but colours may look different on your screen, and printed colours and placement may vary slightly from item to item. These small variations are not defects.
- Product images and mockups are for illustration and may differ slightly from the finished product.
- Product dimensions, finishes and mounting specifications are clearly stated on each product page. Please review sizing carefully before ordering.
- We may change, update or discontinue products, designs or prices at any time.
4. Custom Designs and Your Content
When you create a custom product or upload images, logos, text or other content (“Your Content”):
- You confirm that you own Your Content or have all the rights and permissions needed to use it, and that it does not infringe anyone’s copyright, trademark, privacy or other rights.
- You keep ownership of Your Content. You give ZEYRO and our production partners a non-exclusive, royalty-free licence to use, reproduce and modify Your Content only as needed to preview, produce, ship and support your order.
- You must not submit content that is unlawful, hateful, harassing, sexually explicit, violent, defamatory, or that promotes illegal activity.
- We may refuse or cancel any order containing content that we believe infringes third-party rights or breaks these Terms, and we will refund you if we do.
- You are responsible for checking the spelling, layout, colours and size of your design in the preview before ordering. Custom items are produced exactly as approved.
You agree to indemnify ZEYRO against any claim arising from Your Content, as described in Section 13.
5. Orders and Acceptance
Your order is an offer to buy. We accept your order when we send you a confirmation email. We reserve the right to refuse or cancel any order, or limit quantities, for example if a product is unavailable, if there is an error in pricing or product information, if we suspect fraud, or if the order breaks these Terms. If we cancel an order after payment, we will issue a full refund.
6. Prices and Payment
- All prices are shown in Canadian dollars (CAD) unless stated otherwise and may change without notice. The price that applies is the one shown when you place your order.
- We accept payment through our secure payment processor (Stripe), including Visa, Mastercard, American Express, and Discover. Payment is charged immediately upon placing your order at checkout. Transactions are protected by industry-standard 256-bit SSL encryption.
- Your payment details are processed by our payment providers and are never stored on our servers.
- Applicable taxes may be added at checkout. International orders may be subject to customs duties and import taxes, which are the customer’s responsibility.
7. Shipping and Delivery
Shipping costs are shown at checkout before you pay: a flat rate of $10 in Canada, with free ground shipping on qualifying orders over $150 (product subtotal after discounts, shipped within Canada); .50 CAD to the United States; and .00 CAD internationally. Processing times, delivery estimates, tracking and information about lost or delayed packages are explained in our Shipping Policy, which forms part of these Terms. Risk of loss passes to you when the carrier delivers your order to the shipping address you provided.
8. Returns and Refunds
Returns, exchanges, refunds and cancellations are governed by our Return & Refund Policy, which forms part of these Terms.Collection pieces can be returned within 14 days of delivery under the conditions set out in our Return & Refund Policy; custom and personalised items cannot be returned for a change of mind once production has started.
9. Intellectual Property
All content on our website, including our original designs, artwork, logos, text, graphics, photos and the ZEYRO name and brand, is owned by or licensed to ZEYRO and is protected by intellectual property laws. You may not copy, reproduce, sell, modify or distribute our designs or content without our written permission. Buying a product gives you the right to use and enjoy that product, not the right to reproduce its design.
10. Reviews and Comments
If you post a review, comment or other submission on our website, you confirm that it is honest, based on your own experience and does not contain unlawful, offensive or misleading content. You give us a non-exclusive, royalty-free licence to display and use it in connection with our store. We may remove any submission at our discretion.
11. Prohibited Uses
You may not use our website or content to: break any law; infringe our or anyone else’s intellectual property or privacy rights; submit false or misleading information; upload viruses or malicious code; collect other users’ personal data; scrape or copy our website or designs; interfere with the security or operation of the website; or place fraudulent orders.
12. Disclaimers and Limitation of Liability
Our website and products are provided “as is” and “as available”. To the fullest extent permitted by law, we do not guarantee that the website will be uninterrupted, secure or error-free.
To the fullest extent permitted by law, ZEYRO and its owners, employees and partners will not be liable for any indirect, incidental, special, punitive or consequential damages arising from your use of the website or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
Nothing in these Terms limits any rights you have as a consumer that cannot be excluded or limited under the law of your country or state.
13. Indemnification
You agree to indemnify and hold harmless ZEYRO and its owners, employees and partners from any claims, damages, losses or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, or Your Content, including any claim that Your Content infringes a third party’s rights.
14. Third-Party Services and Links
Our website uses third-party services such as payment providers, production partners and social media embeds, and may contain links to other websites. We are not responsible for third-party websites, content or services, and your use of them is subject to their own terms and policies.
15. Privacy
Your use of our website and any personal information you provide are governed by our Privacy Policy.
16. Errors and Inaccuracies
Occasionally our website may contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions, shipping times or availability. We reserve the right to correct any errors, update information, or cancel orders affected by an error at any time, including after an order has been submitted, and we will refund any payment for a cancelled order.
17. Governing Law and Disputes
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in Quebec, without regard to conflict of law rules. Any dispute that cannot be resolved informally will be handled by the competent courts of the Province of Quebec, unless the law of your place of residence gives you the right to bring a claim in your local courts. If you are a consumer, nothing in these Terms limits the rights you have under the Quebec Consumer Protection Act or any other consumer protection law that applies to you. 18. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining parts will continue in full force and effect.
